When collection crosses the line

Lenders are allowed to pursue overdue loans. What they and their recovery agents are not allowed to do is treat you like a criminal. Under RBI's Fair Practices Code and its 2022 instructions to banks, NBFCs and asset reconstruction companies, the conduct below is considered improper.

Calls outside allowed hours

Contact for recovery is expected only between roughly 8 a.m. and 7 p.m.

Threats or intimidation

Verbal or physical intimidation, abusive language, or threatening calls are not permitted.

Third-party shaming

Discussing your debt with neighbours, employers, or family members without cause.

False representations

Misleading claims about legal consequences, or agents who won't identify themselves.

What you're entitled to, in plain terms

Verified identity

Any recovery agent contacting you should be able to show authorisation from your lender and identify themselves clearly.

§ 2

Reasonable hours

Recovery calls are expected within normal daytime hours — not late at night or before your day begins.

§ 3

No public shaming

Your outstanding dues are a matter between you and your lender — not something to be aired to your neighbours, colleagues, or extended family.

§ 4

Respectful conduct

No threats, abuse, or intimidation — verbal or physical — regardless of how overdue the account is.

§ 5

A written trail

You can ask for communication in writing and keep records of every call, message, and visit for your own protection.

§ 6

Right to escalate

Unresolved harassment can be raised with your lender's internal grievance officer, and then with the RBI's Integrated Ombudsman Scheme if it isn't resolved.

Is loan settlement actually legal in India?

Yes — a one-time settlement (OTS) is something your lender can choose to offer at its own discretion; it isn't something a borrower can force through. Settling usually means paying less than the full outstanding amount in exchange for the account being marked "settled" rather than fully repaid.

Will settling affect my credit score?

Generally, yes. Accounts marked "settled" (rather than "closed") are typically flagged on your credit report for a period and can affect future borrowing. We walk you through this trade-off before you decide anything.

Can you stop the calls immediately?

We can't switch off a lender's systems. What we can do is help you formally document improper conduct and escalate it through the right internal and regulatory channels — which is often what actually changes behaviour.

Do I need a lawyer instead?

Settle Wings is not a law firm and this isn't legal advice. If you've received a legal notice, summons, or are facing a court matter, that needs an independent advocate — we can help you recognise when that point has been reached.
